KeyListing – Terms & Conditions
Effective Date: January, 2nd 2025
These Terms and Conditions (“Terms”) govern the relationship between KeyListing (“Company,” “we,” “us,” or “our”) and licensed real estate professionals (“Realtor,” “Client,” or “you”) who participate in our lead generation and appointment-setting services. By purchasing, accessing, or using our services, you agree to be bound by these Terms.
  1. Services & Lead Delivery
KeyListing provides real estate lead generation, lead qualification, and appointment-setting services.
  1. All leads are generated through proprietary marketing and outreach systems.
  2. Leads may be ISA-verified and may include notes, call recordings, or qualification details when available.
  3. Leads are delivered based on the Client’s selected service area, campaign configuration, and availability.
  4. Lead volume and delivery timelines may vary due to market conditions, seasonality, inventory levels, and campaign performance.
  5. Live call transfers or booked appointments are provided when available but are not guaranteed at all times.
Packages, Pricing & Term
  1. KeyListing offers various service packages, pilot programs, and custom plans.
  2. Pricing, lead quantities, timelines, and service scope may change from time to time and will be outlined in the Client’s written agreement, invoice, or proposal.
  3. Any estimates provided are projections only and not guarantees.
  4. Service terms begin upon payment confirmation and campaign activation, unless otherwise agreed in writing.
Fees & Payment Terms
  1. All fees are flat-fee service fees for marketing, technology, labor, and lead generation services.
  2. KeyListing does not charge commissions, referral fees, or success-based fees unless explicitly stated in a separate written agreement.
  3. Fees are payable in advance unless otherwise agreed in writing.
  4. Accepted payment methods may include e-transfer, credit card, Wise.com, or other approved methods.
  5. Failure to submit payment may delay or suspend service activation.
No Performance Guarantee
KeyListing does not guarantee:
  1. Closings, listings, transactions, or commissions
  2. Conversion rates or response rates
  3. Prospect readiness or timing to transact
Lead generation performance depends on multiple factors, including Realtor responsiveness, follow-up speed, sales skill, market conditions, and pricing strategy. Variability in outcomes does not constitute grounds for refunds or disputes.
  1. Refunds, Cancellations & Chargebacks
All payments made to KeyListing are final and non-refundable, unless otherwise explicitly stated in writing.
No refunds, credits, or replacements will be issued for leads that are unworked, unresponsive, or lost due to Realtor inaction, delayed follow-up, failure to engage, or failure to respond within a reasonable timeframe. Inaction exceeding 30 consecutive days shall constitute abandonment of service.
Realtors may terminate participation with one (1) month written notice. Termination does not entitle the Realtor to any refund for setup fees, unused services, partially delivered services, or remaining lead balances.
Once services have commenced, all setup fees, technology costs, advertising spend, labor costs, and delivered leads are strictly non-refundable.
Any chargeback, payment dispute, or payment reversal initiated after service activation is considered a breach of these Terms. In such cases:
  1. KeyListing may immediately suspend all services
  2. All services rendered and leads delivered prior to the dispute are deemed earned and payable
  3. The Realtor agrees to reimburse KeyListing for chargeback fees, administrative costs, and collection expenses incurred
By activating services, the Realtor acknowledges that dissatisfaction with lead outcomes, prospect behavior, or conversion results does not justify refunds or disputes.
Lead Replacement Policy
Leads may be eligible for replacement only if reported within 24 hours of delivery and only if they meet one of the following criteria:
  1. Disconnected or invalid phone number
  2. Clearly incorrect or duplicate contact information
  3. Unverifiable or fraudulent contact details
Leads will not be replaced for lack of interest, timing objections, price objections, or failure to convert.
Realtor Responsibilities
The Realtor agrees to:
  1. Actively and professionally work all assigned leads
  2. Follow up in a timely manner using best practices
  3. Maintain compliance with all applicable real estate laws, regulations, and brokerage policies
  4. Notify KeyListing in writing of any brokerage, license, or contact information changes
Failure to meet these responsibilities may result in reduced lead allocation, service suspension, or termination without refund.
  1. Confidentiality & Data Use
All lead data, scripts, systems, and processes provided by KeyListing are confidential and proprietary.
The Realtor agrees not to:
  1. Share, resell, or redistribute leads
  2. Misuse or reverse-engineer Company systems
  3. Use lead data outside the scope of the agreed services
Violations may result in immediate termination and legal action.
  1. Prohibited Activities
Realtors must not engage in unethical, misleading, fraudulent, or unlawful conduct involving leads or prospects. Any misuse of services may result in termination and potential legal remedies.
  1. Modifications to Terms
KeyListing reserves the right to update or modify these Terms at any time. Updated Terms will be posted on our website. Continued use of services constitutes acceptance of the revised Terms.
  1. Agreement Acceptance
Participation in onboarding, payment submission, campaign activation, receipt of leads, or access to services constitutes full acknowledgment and acceptance of these Terms.
  1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles.
